The Austrian Federal Law on Safety and Health Protection at Work (Employee Protection Act - ASchG) - for short Employee Protection Act (ASchG) - Federal Law Gazette No. 450/1994 is the most important basic legal regulation for “technical and hygienic worker protection” in Austria. It came into force on January 1, 1995.

background

The ratification of the EEA Agreement (effective from January 1, 1994) and the (later) accession of Austria to the European Union required an alignment of the Austrian labor protection regulations with EU law. The ASchG, the successor law to the Employee Protection Act (Federal Law Gazette No. 234/1972, in the most recently applicable version) is the implementation in particular of the EC framework directive 89/391 / EEC into Austrian law.

scope

The ASchG applies to the employment of employees. The ASchG does not apply to federal employees in agencies to which the Federal Employee Protection Act (BGBl. I No. 70/1999 in the current version) applies, to employees in agricultural and forestry operations within the meaning of the Agricultural Labor Act 1984 (BGBl. No. 287/1984 in the current version), for domestic helpers and domestic workers in private households as well as for home workers.

Specialty

The ASchG regulates the basic requirements, which are specified in a large number of ordinances. See e.g. B. Key feature method and web links. In order to ensure continuity of the protective provisions at the workplace, the transitional law in the ASchG stipulates that numerous older regulations should continue to apply. With the entry into force of ordinances based on the ASchG, the transitional provisions have been reduced considerably.

Further protection provisions

In addition to the Employee Protection Act, the Maternity Protection Act (MSchG) and the Child and Young People Employment Act 1987 (KJBG) are further Austrian laws in the field of employee protection.
