Hans-Hermann Wendhausen

Hans-Hermann Wendhausen (born March 2, 1947 in Helmstedt ) is a German politician. He was a member of the SPD until the end of April 2009 . From 1994 to 2008 he was a member of the Lower Saxony state parliament .

The graduate engineer has been a technical employee at Volkswagen AG in Wolfsburg since 1977 . He is also a member of the supervisory board of Flughafengesellschaft Braunschweig mbH .

Wendhausen continued his employment relationship on paper at Volkswagen even after his election to the state parliament and received a salary from Volkswagen until January 1, 2005 . On July 1, 2005, part-time employment was resumed. VW boss Bernd Pischetsrieder wants to end the employment relationship with the two SPD members of the Lower Saxony state parliament, Ingolf Viereck and Hans-Hermann Wendhausen. For ten years, the two had collected a second salary from VW parallel to their diets of 5400 euros a month without having to work for it.

Since he could not prove that he had made a specific consideration for the salary received from VW, he was asked by the Lower Saxony state parliament president Jürgen Gansäuer to make a payment of € 422,954 to the state of Lower Saxony on the basis of the law on representatives . Wendhausen let it be known through his lawyer that he did not want to repay the prohibited additional income. In doing so, he cites having rendered something in return. However, he left open what consideration he had provided. VW confirmed that Wendhausen had not provided anything in return.

The action for repayment before the Braunschweig Administrative Court was upheld on November 16, 2005. Due to the fundamental importance of the case, however, the possibility of appeal was allowed, which was also filed.

The Lower Saxony Higher Administrative Court ruled on March 13, 2008 that Wendhausen had received payments from Volkswagen AG that were forbidden for several years within the meaning of Section 27 (3) of the Lower Saxony Deputies Act (NAbgG) and therefore had to transfer the amounts received to the State of Lower Saxony.

The appeal to the Federal Administrative Court has not been allowed. The non-admission complaint filed against it was rejected on August 29, 2008 by the 6th Senate of the Federal Administrative Court (6 B 49.08).

At the end of April 2009, Wendhausen left the SPD at his own request. He has not yet announced any official motivation.
