Incongruence indicates a mismatch or a mismatch . It is in contrast to congruence .

Legal meaning

In insolvency law, incongruence is understood to mean the lack of conformity of a service with a previously existing obligation of the provider. The incongruence enables an insolvency contestation according to § 131 InsO with lower conditions than with the congruent performance . In comparison, there is the congruent performance, in which there are higher hurdles for contesting insolvency.
