From 1992 to 1998 he was head of the secret service of Serbia and Yugoslavia Resor državne bezbednosti (RDB) and was considered number two after the head of state Slobodan Milošević . In 2003 he and Franko Simatović were indicted by the International Criminal Tribunal for the Former Yugoslavia in The Hague for crimes against humanity and violations of war laws or customs during the Yugoslav war . Stanišić was later released from custody to prepare for his defense in Belgrade.

In 2013, Stanišić was acquitted of all charges in the first instance. The court held that he supported war criminals, financed them and had them trained in the military, but emphasized that the aid was “of a general nature ” and was not aimed at committing war crimes. In May 2017, the proceedings against Stanišić and Simatović were reopened.
