Military security area
A military security area is in Germany according to § 2 para. 2 of the Law on the Use of Coercive Force and the Exercise of Special Powers by Bundeswehr soldiers and allied forces or civilian security guards (UZwGBw) a military area such. B. a barracks or a military training area , entry of which has been forbidden by the competent military services of the Bundeswehr . This entry ban is effective against private individuals as well as other entities such as the police or other civil authorities - these too are only allowed to enter a military security area with the permission of the Bundeswehr. Military installations of allied armed forces can also be declared military security areas.
In addition, a military security area can also be specifically explained: For example, military security areas are proclaimed at military events such as public vows or accidents involving the Bundeswehr. Military security areas are to be publicly identified as such, e.g. B. with a sign or with a route and posted guards.
In military security areas, members of the Federal Armed Forces - usually the guard, possibly also the military police or other authorized persons - have extensive rights in accordance with the UZwGBw.
In particular, members of the Bundeswehr are entitled to stop and check people. People can also be provisionally arrested and searched. Relevant items can be confiscated. The special powers can be enforced with direct force, possibly also with armed force.
Unauthorized entry into a military security area can and will usually be punished as an administrative offense in accordance with Section 114 with a fine.
Areas that require special secrecy (e.g. telecommunication electronic reconnaissance) are designated as restricted areas within military security areas. Only persons with a special security authorization have access to these areas as part of their function.
