Rasim Delić before the ICTY (2010)

Rasim Delić (born February 4, 1949 in Čelić , † April 16, 2010 in Sarajevo ) was commander in chief of the Bosnian army from 1993 to 1995 . The International Criminal Tribunal for the Former Yugoslavia (ICTY) sentenced him in September 2008 to three years in prison for war crimes .

accusation

Delić has been charged with atrocities committed by foreign Muslim volunteers, known as mujahideen , against Serb and Croatian civilians and soldiers in central Bosnia and the Ozren region.

The prosecution's allegations included:

  • On June 8, 1993, during the Maline massacre, over 200 Croatian soldiers and civilians were captured by Bosnian soldiers and mujahideen. A part of them that was not exactly determined was later led to an intersection. Then the group had to line up and fire was opened on them. The survivors were also shot in the head.
  • On July 24, 1995, a Serb was mistreated and then beheaded. Afterwards, Serbian prisoners were forced to kiss the head hanging on a hook. The inmates were beaten and tortured (including electric shocks).
  • On September 11, 1995, an estimated 60 Serbian soldiers and civilians were captured and, with three exceptions, killed.
  • On September 11, 1995, three women were arrested and taken to a camp. There they were beaten and kicked and maltreated with metal bars and rifle butts. She was then raped.
  • On September 20, 1995, an elderly Serbian civilian was arrested. He was beaten, forced to undress and given water with petrol to drink. After five days he died.

At his first appearance in court on March 3, 2005, Rasim Delić pleaded "not guilty".

Condemnation

In September 2008 Delić was sentenced to three years in prison for violating martial law. Delić, according to the court, was responsible for crimes committed by the military unit "El Mujahidd", which mistreated prisoners in Central Bosnia. However, he could not be found guilty of any complicity in the murder of Serbian and Croatian prisoners in several places in Central Bosnia between 1993 and 1995. This includes in particular the murder of 24 Croatian prisoners in central Bosnia, for which the Mujahideen are held responsible. Delić was also acquitted of a third charge: the shooting of 52 members of the Republika Srpska army in September 1995.
