The Marine Strategy Framework Directive is a European Union directive that aims to protect, conserve and - where practicable - restore the marine environment . All European countries bordering the sea are obliged to implement the goals of the MSFD in their respective marine regions by developing and implementing national strategies . This Directive follows the decision no. 1600/2002 / EC of 22 July 2002 laying down the Sixth Environmental Action Program of the European Community to create a thematic strategy for the protection and preservation of the marine environment , which promotes the general goal of sustainable use of the oceans to promote and preserve marine ecosystems. A transparent and uniform legal framework is required to achieve these goals. This framework is intended to be achieved with the directive. Within this framework, the Member States shall take the necessary measures to achieve or maintain a good status of the marine environment by 2020 at the latest.

The term “marine environment” also refers explicitly to the protection of the species living in the sea and the habitats found there as well as to the prevention of the decline in marine biological diversity. The guideline therefore covers aspects of marine biodiversity protection to a large extent . The biological characteristics and parameters required for the respective assessment and the measures are defined in the annexes of the MSFD. Abiotic as well as biotic factors are taken into account (including the predominant biotope types of the seabed and the water column, the biological communities of the predominant habitats, macroalgae, fish populations, marine mammals, reptiles and seabird species).

In Germany, the Federal Agency for Nature Conservation in the EEZ is responsible for the implementation of the MSFD in the German Baltic and North Sea . In the coastal waters (within the 12 nm zone), responsibility lies with the respective federal states.

In June 2020 the Commission adopted the report required by Article 20 of the Directive. The state of the European seas is therefore mixed. Although some species such as the white-tailed eagle in the Baltic Sea are now recovering, there are signs of a clear decline in other species such as the plate gill in the Mediterranean . In the Mediterranean and Black Seas , at least 87% of commercially exploited fish and shellfish species are overexploited . Approximately 43% of Europe's shelf / slope areas and 79% of the territorial seabed are considered to be physically disturbed, largely attributed to trawling . The report also describes other effects of human activity on the marine ecosystem, such as excessive nutrient input , underwater noise and pollution, for example from plastic waste . As required in Article 23, the directive is to be Template: future / in 2 yearsreviewed by 2023 and adapted if necessary.
