Social Insurance Court of the Canton of Zurich

The Social Insurance Court is one of the three highest cantonal courts in the Canton of Zurich . It assesses complaints and lawsuits in the field of social security law .

For reasons of decentralization, the social security court has its seat in Winterthur .

history

Before the creation of the Social Insurance Court, five different judicial institutions in the canton of Zurich were responsible for the case law in the individual areas of social insurance law. For this reason, the Cantonal Councilor Hermann Weigold submitted a motion in 1985 regarding the creation of a uniform social security court . Against the will of the government council, as well as the cantonal courts and the judicial authorities concerned, the cantonal council decided to follow suit. The law was finally passed by the Cantonal Council in 1994 with 98 against 53. In the referendum it was adopted with a yes-vote share of 55.6%. Court operations began on January 3, 1995 on Lagerhausstrasse in Winterthur.

Duration

The members and half of the substitute members of the Social Insurance Court are elected by the Cantonal Council. The other substitute judges are elected by the Social Insurance Court. The term of office is six years. The court consists of nine members (or the corresponding number of judges to 900 percent) and 6 substitute members.

The members of the higher court are divided into cantonal wage level 27 and receive wages between  CHF 211,700 and CHF 241,467.

The Social Insurance Court is organized into four chambers. The arbitration tribunal, which has equal representation, is attached to it.

Responsibilities

The Social Insurance Court assesses complaints from the field of social insurance law, insofar as federal law provides for a single cantonal authority. The Social Insurance Court is also responsible for other federal and cantonal disputes.

Various disputes between health, accident, disability and military insurance and the respective service providers are decided by the arbitral tribunal.
