Type approval (motor vehicle)
The type approval is a permit to manufacture and market a vehicle, machine or device in accordance with the relevant technical requirements for manufacture ( Certificate of Conformity ). It is issued by an authority designated for this purpose by law.
National
European law
In the European Union, administrative regulations for approval are regulated:
- General motor vehicles and motor vehicle trailers and their parts: until August 31, 2020 by Directive 2007/46 / EC , then by Regulation (EU) 2018/858
- Two, three and four-wheeled [small] vehicles: Regulation (EU) No. 168/2013
- Agricultural or forestry vehicles: Regulation (EU) No. 167/2013
- ECE regulations and ECE homologation , also for the approval of non-European countries
Germany
In Germany the authorities are:
- the Federal Motor Transport Authority for the type approval of motor vehicles in accordance with Section 2 of the EC Vehicle Approval Ordinance
- the Federal Aviation Office for the type certification of aircraft according to § 2 Air Traffic Licensing Regulations
- the Federal Railway Office for the serial approval of railway vehicles in accordance with § 8 of the Railway Commissioning Authorization Ordinance
responsible.
These authorities are also responsible for the type approval of devices and assemblies for these vehicles and the approval of suitable development companies .
In the event of a claim , the entrepreneur is the manufacturer within the meaning of the Product Liability Act . However, he can delegate tasks to an operations manager . This requires a contract that describes the tasks and the allocation of risks . If there is no contract or if the entrepreneur appoints an unsuitable person to be the operations manager, liability ultimately falls on the entrepreneur himself. The same applies to the tasks and management of quality management .
