Ordinance on the elimination of Jews from German economic life

With the ordinance on the elimination of Jews from German economic life ( RGBl. 1938 I, p. 1580) of November 12, 1938, Jews were prohibited from running retail outlets and independently running a craft business with effect from the end of 1938. Jews were also no longer allowed to work as managers and could be dismissed as executive employees without compensation .

A short time later, on December 3, 1938, the “ Ordinance on the Use of Jewish Assets ” (RGBl. 1938 IS 1709) followed, which went far beyond the required implementing provisions and forced Jews to sell their real estate and to give them access to their savings withdrawn.

The "Ordinance on the Elimination of Jews from German Economic Life", which was issued immediately after the November pogroms , is very likely to be the tightened version of a draft that was drawn up at the beginning of November.

Jews according to the definition of the First Ordinance of the Reich Citizenship Law were banned from running retail outlets, mail-order businesses and the like from January 1, 1939. The exercise of trade in markets and trade fairs was also prohibited. The independent operation of a craft was also prohibited.

Jews were no longer allowed to be “operators”. A second implementing ordinance also no longer allowed Jews to be “Deputy Operators”. As executives, they could be terminated with six weeks' notice without severance pay.

The Reich Minister of Economics was authorized to issue the necessary implementing provisions and to create exceptional regulations insofar as this was necessary for the transfer to non-Jewish possession.

Validity

The ordinance was issued on November 12, 1938. As early as December 3, 1938, the “Ordinance on the Use of Jewish Assets” changed it considerably and expanded its content. The ordinance was formally repealed on September 20, 1945 by the Control Council Act No. 1 concerning the repeal of Nazi law .
