Elément legal

In French criminal law, élément légal is a prerequisite for criminal liability . The élément légal is an expression of the constitutional principle of the principe de légalité (~ principle of legality). The French teaching examines the existence of the élément légal in two steps: 1. Is there a legal provision that penalizes the behavior to be tested? and 2. Are there any circumstances that prevent the provision from being applicable?
