Overdraft ban

In German law, the prohibition of over- attachment in the case of foreclosure in movable objects prohibits the extension of the foreclosure further than is necessary to satisfy the obligee and to cover the costs of the foreclosure ( Section 803 (1) sentence 2 Code of Civil Procedure ). It does not apply to real estate in the foreclosure auction. As with self-defense, it means necessary but not proportionate. Even with a claim of € 500, a car can be seized that has 10 times the value if an amicable settlement ( § 806b ZPO) has failed and the claim cannot be satisfied in any other way.
