The ASB Schuldnerberatungen GmbH ( asb ) is an umbrella association of recognized debt counseling in Austria. It is a GmbH based in Linz (Upper Austria). In private bankruptcy, asb also takes on the role of trustee in the skimming procedure .

The umbrella organization of the state-recognized debt advisory services coordinates the common interests of the debt advisory services and acts as a liaison between the debt advisory services and ministries, science, social institutions and groups of creditors. In addition to public relations work and the regular exchange of information, the main areas of activity are training and further education, the optimization of content and organizational standards, as well as research and documentation. Within the framework of the debt settlement procedure ( private bankruptcy), asb takes on the role of trustee in the skimming procedure. At the European level, the asb collaborates in the networking of similar institutions.

The state-recognized debt advisory services in Austria are members of the asb advisory board and can each be represented with one vote. There are currently ten state-approved debt advice centers in Austria with numerous associated regional offices and supervised consultation days throughout Austria.
Most of the debt advisory services are organized as non-profit associations under private law. Some are integrated into public institutions (e.g. magistrate) or organized as a non-profit company with limited liability. They are largely financed by the public sector (federal states, cities, labor market service, other institutions).
The Ministry of Justice can declare counseling centers that meet certain quality criteria to be “state-approved debt counseling”; these advice centers can represent debtors in court according to the insolvency regulations.
The association work with funds from the Federal Ministry of Labor, Social Affairs and Consumer Protection and the Federal Ministry of Justice.
history
Debt counseling has been organized throughout Austria since the late 1980s. The umbrella organization asb was founded as an association in 1992 and converted into a GmbH at the end of 2002. According to Section 267 (1) IO a right to comment before the decision on the priority of debt counseling by the president of the competent higher regional court. Since 1995, with the entry into force of the " private bankruptcy", there have been privileged debt counseling, which are also mentioned by name as "debt counseling" in the bankruptcy code and are allowed to represent in court.
