Transfer agreement

The transfer agreement is a mutual contract with which a subsequent tenant of an apartment or house undertakes to take over the existing furniture or some of the furnishings of the previous tenant against payment of a transfer fee .

The transfer agreement is a purchase contract conditional upon the conclusion of the new rental agreement . If the fair value of the furniture is exceeded by more than 50%, the transfer agreement already made may be ineffective due to usury and the wrongly paid purchase price may be reclaimed in accordance with the provisions on unjust enrichment .
