Amiable compositeur
Acting as an amiable compositeur in proceedings before an arbitral tribunal gives the arbitrator the opportunity to decide the dispute - without being bound by the applicable law - solely under the criterion of fair discretion (see e.g. the ICC Arbitration Rules in Art. 21 para. 3).
