animus rem sibi habendi

The " animus rem sibi habendi " ( Latin for "attitude to have a thing for oneself" = civil law, the will to own ) is the intention of appropriation , which is important in criminal law .

In Section 242 of the Criminal Code, it is the intention of appropriation that goes beyond mere intent ("with the intention of illegally appropriating the thing") that completes the subjective offense of theft .

In Section 246 of the Criminal Code ( embezzlement ), the prevailing opinion allows every manifestation of the will to apologize to be sufficient to fulfill the objective characteristic of “appropriation”.
