Certificate of employment
The certificate of employment is a form with which the previous employer must certify all facts that may be relevant for the decision on the entitlement to unemployment benefit to the Federal Employment Agency upon termination of an employment relationship .
The duty of the employer in Germany to issue a certificate of employment results from Section 312 of the Third Book of the Social Code .
In the form of the Federal Employment Agency (BA) he has to enter in particular:
- the type of activity of the employee ,
- Start, end, interruptions and reason for the termination of the employment relationship,
- the pay and other cash benefits which the employee has received or to claim.
If an employer refuses to issue a required certificate of employment to the employee who has left the company, the Employment Agency can impose a fine of up to € 2,000 on him in accordance with Section 404 SGB III .
A differentiation from the employment certificate is an employment confirmation, with which an employer confirms an ongoing or contractually guaranteed employment relationship .
