In Switzerland , the right of asylum is regulated by the Asylum Act ( AsylG ) and the ordinances attached to it. The basis is the Federal Constitution (BV), which stipulates:

Art. 25 BV: Protection against deportation, extradition and deportation

1 Swiss nationals may not be expelled from Switzerland; they may only be extradited to a foreign authority with their consent.
2 Refugees may not be deported or extradited to a country in which they are persecuted.
3 Nobody may be deported to a state where they are threatened with torture or any other type of cruel and inhuman treatment or punishment.

Art. 121 BV:

1 Legislation on the entry and exit, residence and settlement of foreigners as well as on the granting of asylum is a federal matter.
2 Foreign nationals can be expelled from Switzerland if they endanger the security of the country.

The Swiss Asylum Act (AsylG) was passed on June 26, 1998 (BBl 1998 3525) and came into force on October 1, 1999.

Since then there have been changes on December 13, 2002, June 20, 2003, December 19, 2003, June 18, 2004, November 3, 2004, December 17, 2004, June 17, 2005, December 16 and 20, 2005, December 24, 2004. October 2007 and June 13, 2008. Further changes followed (including June 15, 2012 and September 28, 2012).

The Swiss asylum legislation was at times heatedly discussed between right-wing parties (e.g. Swiss People's Party ) and other parties as well as aid agencies, churches and the UNHCR . The latter launched a referendum on December 21, 2005 . This referendum against the revised Asylum Act received 100,000 signatures, significantly more than the required quorum . The voting proposal (for a restrictive asylum law) was clearly accepted by the people on September 24, 2006.

Precursor law

The Asylum Act, which came into force in 1999, is a total revision of the Asylum Act passed in 1979 and valid from January 1, 1981, the first asylum law of the Confederation.
