Autorité de la Concurrence

The French Autorité de la Concurrence ( German  competition authority ) based in Paris is the national competition authority of France , which has existed in its current form since 2008.

Basis and tasks

The authority was created by law of August 4, 2008 ( loi de modernization de l'économie n ° 2008-776 ) as an independent competition authority. It is the successor organization to the Conseil de la Concurrence (literally: Competition Council) with considerably expanded competencies. It is not a consultative body, but is directly responsible for controlling company concentrations and violations of competition legislation and has the necessary skills and resources to independently identify and make recommendations to the relevant ministers.

Predecessor authorities

The former French Competition Council was founded on December 1, 1986. It emerged in turn from the Competition Commission ( Commission de la Concurrence ), which existed since June 19, 1977. This in turn builds on the work of the French Commission technique des ententes , which was founded on August 9, 1953.

Although the French Competition Council was not formally an authority and was subordinate to the Minister for Economic Affairs, it was able to issue declarations and impose sanctions in the event of violations of competition law. Since March 15, 2001, the competition law and thus the sanction options of the Competition Council have been significantly tightened. In addition to Section L464-2 of the Commercial Code (Code du Commerce le Conseil de la Concurrence peut infliger une sanction pécuniaire soit immédiatement soit en cas d'inexécution des injonctions ) and other commercial laws, it can be based on Articles 81 and 82 of the Treaty of the European Community.
