Citizens' deputies are citizens who participate in the work of the committees of a district assembly in Berlin with voting rights. Non-German citizens can also become citizens' deputies.

Basics

The participation of voluntary citizens in committees of the district assembly has constitutional status.

Deputies are generally members of a delegation who, on behalf of an assembly, bring wishes or demands to a political body. In this sense, citizens' deputies should also bring the interests of the citizens of the district into the committees when discussing local political issues. This idea of ​​an element of direct democracy was already found in the original version of the Berlin District Administration Act. Here is u. a. "Citizens 'deputies are knowledgeable citizens who are entitled to vote in the work of the committees of the district assembly. Foreigners can also become citizens' deputies."

Choices and scope

Citizens' deputies are elected by the district assembly on the proposal of the parliamentary groups. The election takes place for the duration of the electoral term. Citizens' deputies can also be recalled by the district assembly with a 2/3 majority.

A district assembly can elect up to four citizens' deputies to the committees that it forms; the district assembly must form the majority.

requirements

Citizens' deputy or deputy can only be who has reached the age of 18, has his main residence in Berlin, is not a member of the House of Representatives or a district assembly, is not employed in the same district administration as a civil servant or employee and is not a member or auditor of the Court of Auditors.

Legal status

The legal status of citizens' deputies in committees is essentially identical to that of district councilors; they have the right to vote, speak and propose to the committees.

compensation

Citizens' deputies also receive an expense allowance. In contrast to district councilors, this only relates to participation in committee meetings. Basic compensation and other allowances are not granted (cf. § 23 BezVG).
