Civil Rights Action refers to a lawsuit that can be used to assert the violation of civil rights .

The term is mainly used as a translation of the English term "Civil Rights Claim", which plays an important role in the USA in particular.

Germany

In Germany, the violation of fundamental rights can be asserted against measures of the public administration with any legal remedy . Since the fundamental rights have constitutional status, they must be observed by all courts and authorities; a special type of complaint is not required. After the legal process has been exhausted , the violation of fundamental rights can be asserted with the constitutional complaint at the Federal Constitutional Court .

In the USA, various legal provisions guarantee the assertion of civil rights violations. The most important of these provisions, 42 USC Section 1983, was incorporated into the constitution as early as 1871 by the so-called Ku Klux Clan Act.
