Liberated Guardian

An exempt guardian is a guardian who is exempt from certain duties related to the ward's property management . These are in detail:

Provided they name a certain person as guardian in the will, the parents can declare this person to be the exempt guardian. Historically, this right was only available to the father ( § 1852 BGB), but now the mother can also make this provision in the same way ( § 1855 BGB). The family court can revoke this declaration if it would jeopardize the interests of the ward. ( § 1857 BGB) The association as association guardian and the youth welfare office as official guardian are legally exempt guardians. ( § 1857a BGB)

Liberated supervisor

Analogous to the liberated guardian are in guardianship law to exempt caregivers . Section 1908i, Paragraph 2, Clause 2 of the German Civil Code (BGB) determines some groups of people who are automatically considered exempted carers: father, mother, spouse, descendant (children, grandchildren, great-grandchildren) as well as club caretakers and officials . However, the supervisory court can withdraw the exemption in individual cases. As with the exempt guardian, the care association and the care authority , if they are appointed as guardians, are automatically exempted guardians; this right cannot be withdrawn from them.
