Check and credit card abuse

The check and credit card abuse is a criminal offense of Swiss criminal law . It is one of the fraud-like property offenses and aims to protect the assets of the issuer of check and credit cards .

The criminal offense is standardized in Article 148 of the Criminal Code and is as follows:

1. Anyone who, although insolvent or unwilling to pay, uses a check or credit card provided by the exhibitor or a similar payment instrument in order to obtain financial performance and thereby damage the exhibitor's assets, will, provided that the exhibitor and the contracting company take reasonable measures against the misuse of the card, punished with imprisonment of up to five years or a fine.

2. If the offender is acting commercially, he will be punished with imprisonment of up to ten years or a fine not less than 90 daily rates.
