The Austrian Data Protection Council advises the Federal Government and the provincial governments on their request on questions of legal policy relating to data protection .

Assignments and history

The Data Protection Council was created with the Data Protection Act 2000 . It is set up as its office at the Federal Ministry of Justice .

Its tasks are (§ 41 Para. 2 Z. 1–6 DSG 2000):

  • Consult questions of fundamental importance for data protection and prepare or commission expert reports
  • To give opinions on draft bills of the federal ministries, insofar as these are of importance under data protection law (giving the data protection council the opportunity to do so is binding)
  • Statements on projects by clients in the public sector , insofar as these are of importance in terms of data protection law (submission to the council is binding; the council also has the right to request information and reports as well as inspection of documents from them; internal affairs of recognized churches and religious communities are excluded ; Lines 3 and 4)
  • Call on clients in the private sector to comment on developments of general significance under data protection law
  • Communicate observations, concerns and any suggestions to improve data protection in Austria to the federal and state governments, and bring them to the attention of the legislative bodies (through the intermediary of these bodies)

The Data Protection Council has representatives of political parties , the Federal Chamber of Labor , the Chamber of Commerce Austria , the country , the Association of Municipalities , the City State and one from the Federal to ernennender representatives of the Federal (§ 42 DSG 2000). Professional experience in the field of IT and data protection is expressly provided for the representatives of the regional authorities. The activity is voluntary , the members are obliged to maintain secrecy if secrecy is required in the public interest or in the interest of a party, and the deliberations are confidential, unless the council itself decides otherwise (§ 42 line 6 and § 44 line 8 and 7).

The data protection council has 18 members (as of 2017).
