Theft (Switzerland)

In Swiss criminal law, theft is an offense against property according to Art. 139 StGB . Since the wording of the Austrian and Swiss law on theft largely corresponds to that of the German Criminal Code, the considerations made on the individual elements of the offense also apply to the criminal law of these three countries.

Legal text of the Swiss Criminal Code (Art. 139 StGB):

Art. 139 Theft. 1. Whoever takes away someone else's movable property for appropriation in order to unlawfully enrich himself or someone else is punished with imprisonment of up to five years or a fine.

An additional element of the offense is that the perpetrator wants to unlawfully enrich himself or a third party by appropriating it. All elements of the offense (especially: someone else's movable property; removal from someone else's custody; appropriation; enrichment) must be covered by the offender's intent at the time of the offense .
