Excuse me
In German criminal law , reasons for excuse are certain circumstances which, if present, reduce the individual's ability to be reproached and the act therefore no longer appears to be punishable. In contrast, a reason to exclude guilt completely eliminates the guilty content of the act ( exculpation ).
These excuses are in particular:
- excused state of emergency ( § 35 StGB )
- Exceeding self-defense ( Section 33 StGB)
- official orders / instructions / commands ( necessity )
- excusing conflict of duties
- Unreasonableness of normal behavior (especially in the case of negligence offenses )
Examples of reasons to exclude guilt:
- unavoidable error of prohibition ( § 17 StGB )
- Incapacity
In contrast to the reasons for apology, if a reason for justification intervenes (main example: self-defense ), the illegality of the act is no longer valid.
