The negligent false declaration and the negligent false affirmation in lieu of an oath denote certain statements offenses in the German Criminal Code that are committed by anyone who commits one of the acts outlined in Sections 154 to 156 of the Criminal Code , d. H. anyone who negligently takes on his oath an actually false statement or declaration, which he considers to be true, before a court or an authority authorized to take the oath. In the case of perjury and the other willful acts referred to, however, the declaring person knows that the information in question is not true.
The negligent false decision is regulated in § 161 StGB . The negligence can lie in the fact that the perpetrator does not strain his memory properly or is not sure which statements the oath extends to.
With effect from November 5, 2008, the regulation previously contained in Section 163 StGB was renumbered in Section 161 StGB, and the provision of Section 162 StGB was newly inserted into the Criminal Code to implement the Rome Statute of the International Criminal Court . According to Art. 70, Paragraph 4, Letter a in conjunction with Paragraph 1, Letter a of the Statute, each contracting state is obliged to extend criminal provisions for the protection of the administration of justice, in this case testimony offenses, to willful false statements in proceedings pending at the International Criminal Court (ICC) in Switzerland or by a national of the contracting state abroad. Section 162 (1) of the Criminal Code also includes negligent false statements and negligent false statements on oath for information before an international court. Section 162 (2) of the Criminal Code, on the other hand , negligently excludes false, unlawful statements before an investigative committee of a federal or state legislative body from criminal liability.
