Family company that manages assets

Under an asset management company family (also family holding company called) one understands the corporate summary of the assets of a family with the participation of all or several family members.

In practice, it is managed in various legal forms , namely above all as a company under civil law , limited partnership , GmbH & Co. KG and GmbH . The aim of a family company is the flexible management and long-term maintenance of family assets. It can also be advantageous from a tax point of view, as income and increases in value are shifted to several people, especially from the generation of children and grandchildren. The establishment of an asset management family company usually takes place in connection with the planning of asset succession.

There are many advantages to transferring shares in a family company (in which all individual assets are grouped together) over transferring fractions of the individual assets themselves. The transfer of wealth is more flexible and the wealth is protected from fragmentation. The transferring party can reserve extensive decision-making powers and income. It offers furthermore the tax-advantaged way to private funds by introducing a deemed commercial family company (eg. B. GmbH & Co. KG) in operating assets to transform and thus the tax breaks to take for the transfer of business assets to complete. In addition, creditors and dependents of a partner do not have access to the company's assets. Here the family company offers a protective function. An additional advantage is that even minors become shareholders of a family company and can thus benefit from gifts at an early stage. Appropriate regulations in the articles of association can also prevent minors from influencing decisions.
