Film / TV Agreement (Austria)

The film / television agreement is an agreement on film funding in Austria that was concluded on October 12, 1981 between the Austrian Film Institute (ÖFI) and the Austrian Broadcasting Corporation (ORF) and revised on January 14, 2006.

It provides for the promotion of cooperation between the film industry and television, for which the ORF provides funds of currently 5.96 million euros annually to co-finance the production costs of Austrian films . In return, the ORF is entitled to watch the films financed by the agreement as often as desired within the license period (currently 7 years) within the license period (currently 7 years) after the respective cinema protection period (currently 24 months after the Austrian theatrical release) has expired, for Austria (exclusively) and South Tyrol (not exclusively). then a complete revocation of rights to the manufacturer takes place.

After covering the manufacturing costs incurred by the manufacturer (plus a 7.5% manufacturer profit), the ORF is entitled to a share in the proceeds based on its financing share. Any shares of the ORF's revenue from the cinema and television exploitation of the films funded by the agreement will be used to top up the respective annual amount. If agreement funds are not used in a calendar year, these funds are generally carried over, but only to the immediately following calendar year.

The decision on the allocation of funds is made by a joint commission made up of three members each from the Film Institute and ORF. The producer of the film to be financed is entitled to apply. In any case, the prerequisite for this is an upright commitment to funding from the film institute.

Up to 10 per cent of the agreement funds are dedicated to the special promotion of young talent films, films with an innovative character, short films and documentaries. The co-financing of such film projects requires that the financial resources required for the film production are provided jointly by the ORF and the film institute or another film funding institution.
