Counter-draft

From a counter-proposal (also direct counter-proposal called) says the federal constitution of Switzerland in Article 139 (popular initiative for partial revision of the Federal Constitution) in connection with the by a popular initiative brought about a referendum on a constitutional amendment. The Federal Assembly will put the counter-draft to the vote as an alternative to submitting the initiative. In the vote, since 1987, those entitled to vote have been able to accept both proposals with the so-called " double yes " and express their preference in the event that both are accepted by means of a ballot question.

In the case of an indirect counter-proposal , the Federal Assembly or the Federal Council opposes the initiative with a legislative change or proposal in a referendum, which should take into account the core of the popular initiative but go less far. At the time of the vote, the issue is either already in the form of a law, which comes into force in the event of a rejection, or is only available as a draft law. In the second case, the legislature or the Federal Council only expresses that it is willing to take up the matter, deal with it in the parliamentary procedure and let it flow into a law. An example of the first case is the naturalization initiative, in which a less drastic change in the law in the event of a rejection had already been decided.
