Overall protection rate

The total protection quota is the proportion of all asylum recognitions, granting of refugee protection ( subsidiary protection or refugee status ) and determinations of a ban on deportation within a period based on the total number of decisions in this regard in the relevant period.

Furthermore, the overall protection rate related to the country of origin means the proportion of these decisions (asylum recognition, granting of subsidiary protection or refugee status as well as declarations of a ban on deportation) in relation to the total number of related decisions made in the relevant period on persons from the relevant country of origin.

The media sometimes only speak of a “protection rate”, although this term is fuzzy in that it can refer to the overall protection rate on the one hand or to the asylum recognition rate on the other.

Germany

In Germany, the total protection rate is calculated from:

divided by the total number of decisions by the Federal Office for Migration and Refugees (BAMF).

The adjusted total protection rate is calculated by subtracting all “formal decisions” from the total number of decisions by the BAMF. The “formal decisions” are those in which the BAMF does not make a substantive statement on the application, but rather the cases are dealt with elsewhere before the official decision is made. Examples of this are formal decisions due to a change in residence status due to marriage or due to the jurisdiction of another EU member state in accordance with the Dublin III Regulation or, previously, the Dublin II Regulation / Dublin Convention . The adjusted total protection rate is thus higher than the total protection rate.

The asylum applications that were rejected by the BAMF but later sued before an administrative court are not included in the overall protection rate or the adjusted overall protection rate.
