Half-penalty

The term semi- punishment is understood to mean the early release from prison , referred to in the German Criminal Code (StGB) as “ suspension of the remainder of the sentence on probation ” after serving half of the sentence with a positive social prognosis . It is regulated in Section 57  (2) of the Criminal Code.

It can be granted if

  • the convicted person is serving a prison sentence for the first time and does not exceed two years or
  • the overall assessment of the offense, personality of the convicted person and their development during the execution of the sentence shows that special circumstances exist

and

  • the other requirements of paragraph 1 are met.

In the event of a relapse within the probation period, the pronounced sentence can continue to be enforced.
