Sovereign administration

The sovereign administration is that part of the public administration that proceeds with sovereign means. According to this, there is sovereign administration when administrative bodies act in accordance with the statutory authorizations in those legal forms that public law makes available for the exercise of official powers. This includes issuing notices and ordinances as well as exercising direct administrative authority and compulsory power . In contrast to this, one speaks of private sector or fiscal administration when the administrative bodies make use of those types of legal clauses that are also available to private parties (e.g. purchase orService contract ).
