Institute Cargo Clauses

Institute Cargo Clauses (ICC) is the name given to the transport insurance conditions, policy forms and clauses for transport insurance contracts issued by the International Underwriting Association of London (IUA) , which primarily concern sea transport but also land transport risks.

Almost all transport insurances worldwide are based on the Institute Cargo Clauses.

Types of insurance clauses

  • The ICC distinguishes between three insurance clauses:
    • ICC A: offers the highest insurance protection (all-risk)
    • ICC B: provides coverage for explicitly mentioned risks (named peril principle) (risks 1–11 according to the ICC list of risks)
    • ICC C: offers a minimum insurance protection against explicitly mentioned damaging events, for mentioned damaging events, e.g. B. Major average , fire, stranding , transport accident , seaquake , etc. (named peril principle) (dangers 1–7 according to the ICC list of dangers)
  • ICC hazard list
    • 1: fire and explosion
    • 2: Stranding, running aground, capsizing
    • 3: Land transport overturning and derailing
    • 4: Collision or contact of the means of transport with other objects, except water
    • 5: Unloading goods in an emergency port
    • 6: Sacrifice and throwing the sea at the great average
    • 7: Contributions to the general average and salvage costs
    • 8-11: include e.g. B. overboard flushing, earthquakes, volcanic eruptions, lightning strikes, as well as penetration of sea and river water into the means of transport, the container or the storage area.

Relation to the Incoterms clauses

Numbers 1–7 of the hazard list correspond to the minimum coverage according to the Incoterms Clause Cost, Insurance, Freight ( CIF ) (according to Incoterms 2000/2010).

Further insurance options

The following can also be agreed: Institute War Clauses, Institute Strike Clauses, Malicious Damage Clauses (for willful damage or destruction), Institute Commodity Trade Clauses and Protection and Indemnity Clauses.

Application in Germany

It is easily possible and quite common to base German transport insurers on the ICC and related clauses.

In the meantime, however, the "DTV-Güterversicherungsbedingungen 2000 in the version 2008 (DTV-Güter 2000/2008)" of the General Association of the German Insurance Industry (GDV), which recommend similar transport insurance conditions, are also used for the German area .
