The Thuringian state parliament has 91 members . Of these, 44 are elected via state lists (second vote) and a further 44 via constituencies. The constituency candidate with a relative majority is elected. In the event of a tie, the lot drawn by the district election officer decides .
The state electoral law provides for compensatory mandates in Section 5 (6) if a party has more constituency members than it would be entitled to after the second vote ( overhang mandates ). It is therefore always ensured that the strength of the political groups corresponds to the result of the second vote.
The constituency of the constituencies is specified in the annex to Section 2 (1) of the State Election Act. It was changed by the fifth law amending the Thuringian state election law of March 22, 2012. This affected the districts of Hildburghausen and Schmalkalden-Meiningen (constituencies 12 - Schmalkalden-Meiningen I, 13 - Schmalkalden-Meiningen II, 18 - Hildburghausen I / Schmalkalden-Meiningen III, 21 - Suhl / Schmalkalden-Meiningen IV) and the independent city of Weimar ( Constituencies 31 - Weimar I / Weimarer Land II, 32 - Weimar II).
The sixth law amending the Thuringian state electoral law of March 24, 2017, the constituencies 2 (Eichsfeld II), 10 (Kyffhäuserkreis I), 18 (Hildburghausen I - Schmalkalden-Meiningen III), 20 (Hildburghausen II - Sonneberg II), 24 to 27 (Erfurt I to IV) as well as 37 and 38 (Jena I and II) partly re-cut.
