Abuse of authority

The Austrian Criminal Code defines the general abuse of office threatened with imprisonment in § 302 StGB - abuse of official authority - as the intent of an official, his authority, on behalf of the federal government, a state, a community association, a municipality or another person under public law as their organ to carry out official business in enforcement of the law, to knowingly abuse it in order to damage someone else's rights.

In addition, Sections 302–313 (Section 2) of the Criminal Code define further official offenses .
