Competitor
The competitor is a fair trade term. On the one hand, it is a prerequisite for many regulations in the UWG (e.g. § 4 No. 7, 8, 10 or § 6 UWG), on the other hand it is also one of the entitlements under § 8 UWG.
For Germany, the term is legally defined in Section 2 (1) No. 3 UWG . According to this, a competitor is any entrepreneur who has a specific competitive relationship with one or more entrepreneurs as providers or buyers of goods or services. The specific competitive relationship exists when both parties try to sell similar goods or commercial services within the same group of end consumers and the competitive behavior of one therefore affects the other, i.e. H. can hinder or disturb the paragraph. However, a competitive relationship can only arise through a specific action (so-called ad hoc competitive relationship). The best example of this is the advertising request “Buy onco instead of flowers”.
