In case law, non-fulfillment is the failure to fulfill an obligation to perform . Even after the reform of the law of obligations, this leads to a breach of duty according to § 280 BGB . The non-fulfillment is to be distinguished from the bad fulfillment . a. from § 340 and § 341 BGB shows.

The non-fulfillment does not in itself justify a claim for damages . This would only arise if further requirements were added.

The non-fulfillment can result from impossibility , from refusal to perform or from delay in the provision of services, so that the legal consequences arise thereafter .
