Pawnshop

from Wikipedia, the free encyclopedia

A pledge chamber is a room in which the bailiff stores pawns that he does not leave in the debtor's custody (Section 268 (1) GVGA). If the bailiff maintains a pledge chamber at his own expense, he must make the pledge chamber available for the accommodation and safekeeping of pledged items in the recovery process (Section 246 GVGA). In the latter case, the bailiff can set the costs of custody as costs of enforcement.

Example: When the property or apartment is cleared, the home furnishings and other "belongings" of the debtor are removed by the bailiff and made available to the debtor. If the debtor is unable to accommodate, the bailiff will take these items for safekeeping in the depository for a maximum of two months. If the debtor cannot pay the custody costs incurred after these two months or if he does not pick up his things, the bailiff will auction the things and deposit the auction proceeds. Objects that cannot be used are taken to the landfill ( § 885 ZPO ).
