Police measure

All (incriminating) interventions by the state in the rights of the citizen, so-called right of intervention, are referred to as a measure in the sense of police law . The rights of people residing in Germany are determined by the Basic Law (catalog of basic rights).

Such interference in the rights of the citizen always requires a legal basis , ie a legitimation that allows the state to restrict the right resulting from the Basic Law, so-called authorization to intervene .

Citizens (i.e. addressees of the measure) within the meaning of this definition are not only citizens, but the respective holders of fundamental rights. These can also be asylum seekers , tourists or people staying illegally in Germany.
