Position mark (right)

In German trademark law, a position mark is a form of a trademark ("other trademark form", Section 6 No. 6 and Section 12 Paragraph 1 of the Trademark Ordinance), which claims a constant placement on the marked goods . The placement must be included in the description of the trademark when it is registered. The brand itself can be a word mark , a figurative mark or the like.

The placement cannot be used to give the mark the distinctiveness required for registration .

Example : Red stripe on the bottom of the heel in Lloyd brand shoes .
