R v Gibson

R v Gibson and another [1991] 1 All ER 439, [1990] 2 QB 619, [1990] 3 WLR 595, [1990] Crim LR 738, 91 Cr App Rep 341, 155 JP 126 is a decision of the Criminal Division of Court of Appeal from 1991. The Canadian artist Rick Gibson wascharged with outraging public decency because he hadfreeze-dried fetuses shown as earrings on a modelin the London Young Unknowns Gallery of the co-accused gallery owner Peter Sylveire. The problem was that the offense mentioned did not exist according to statute law , but only according to common law and the traditional decisions were only sparse. The court upheld the conviction, considering the existence of such a crime to be established under common law .
