Real association

A real association is a legal form for joint property. Real associations are traced back to Germanic community law. Only in Lower Saxony are they described in the form of a law.

The prefix "Real-" refers to the land as material possession, which is more common in English as "real estate". The purpose of the association is the joint maintenance or management of real estate such as paths, bodies of water or forests. The Realverband is thus similar to a Zweckverband . The Lower Saxony Realverbandsgesetz (RealVG ND) has summarized earlier legal norms for interests, real communities and forest, real, road and wood cooperatives since 1969 ; the last amendment dates from 2012. The law describes the Realverband as a corporation under public law, which is formed by the owners of the association shares. Each member can hold one or more shares. A distinction is made between “independent” and “dependent” shares, whereby the independent ones can be transferred through legal transactions. Dependent shares, on the other hand, relate to indivisible property such as B. shared paths.

Among the various legal forms for forest owners , a real association forest according to the Federal Forest Act does not generally belong to corporate forests . The voting rights are based on the number of shares, in contrast to a normal cooperative according to the cooperative law, not on heads.
