Legal certificate

A legal force certificate is a certificate in accordance with German proceeding that a court decision legal force has attained. It is issued if the party subject to the legal dispute has not lodged an appeal or any other legal remedy within the period provided for this, has been legally waived (e.g. when the judgment is pronounced) or if no legal remedy is possible against the decision, for example if a decision by the Federal Court of Justice or the higher regional courts. The legally binding certificate is issued by the clerk of the office and placed as a note on the execution of the decision.

The legal basis for the final certificate is provided by § 706 ZPO .

If a court decision contains the note " Enforceable copy ", it cannot be concluded that the decision is final. Some decisions are of creditors provisionally enforceable , but still from the same or next instance court can be lifted.
