Pension for miners

The pension for miners is a special form of disability pension that is part of the miner's pension. It is regulated in § 45 SGB ​​VI.

Insured persons who are incapable of working in the mining industry , who have completed the general qualifying period of five years and who have had at least three years of compulsory contribution periods in the five years prior to the incapacity are entitled to the pension for miners . As with the disability pension, the period of five years is extended by crediting times and periods of consideration , and the regulations on early fulfillment of the waiting period must also be applied.

An insured person is unable to work if he is unable to work in the previous employment or in any other equivalent employment. An insured person who actually carries out an equivalent job or a self-employed activity outside of mining is not incapable of working. The labor market situation is not to be taken into account here.

According to Paragraph 3, miners are also entitled to a pension if the insured person has reached the age of 50, does not actually work in an equivalent job and has completed the waiting period of 25 years.

Until December 31, 1983, miners' pension was paid even if the person was no longer compulsorily insured in the statutory pension scheme when the disability occurred. According to Section 242 (2) SGB VI, this regulation continues to apply to old cases.
