Rent neurosis

from Wikipedia, the free encyclopedia

A pension neurosis is understood to be a psychological state that emerges after an accident, for example , in which the injured person no longer wants to pursue a regular professional life after his or her psychological or physical injury has healed. It is a form of desire neurosis , a secondary expression disease .

Legal evaluation

According to German law, the person who caused the accident or who caused the damage must generally pay for all damage. This also includes psychological consequential damage . If there is no financial loss, compensation in the form of compensation for pain and suffering may be possible . However, if psychological damage leads to the injured party no longer being able to (fully) pursue his or her profession, this represents damage that can be measured in monetary terms.

For the question of compensation , it is of crucial importance whether the mentally induced disability can be traced back to the behavior of the injuring party. In principle, there is also a claim for damages in the event of psychological processing errors. However, negative psychological consequences are only recognized by a court if they are caused by an exceptionally stressful event. Everyday occurrences do not come into consideration as the cause of an illness. However, it should be noted that the victim's particular sensitivity (susceptibility to damage; vulnerability ) does not relieve the perpetrator.

The problem is that the injured party is generally required to provide evidence of the extent of the damage . However, a gathering of evidence can lead to an update of the trauma (worsening of the disease state). The statute of limitations can also mean that the injuring party no longer has to pay for the damage, since consequential psychological damage often only occurs or is recognized after several years.

Legal consequence

There is no claim for damages in the case of minor damage or a neurosis of desire. In the latter case, the injured party merely evades the difficulties of professional life and takes the accident as an opportunity to hold the injured party responsible. It is precisely the prospect of a claim for damages that creates the desire neurosis.
