Report

The factual report is part of the relationship in the judiciary . It contains a formalized presentation of the facts on which the subsequent judgment is based. The factual report in the civil process is structured according to Section 313 (2) ZPO as follows:

  1. introduction
  2. undisputed facts
  3. disputed factual arguments of the plaintiff
  4. Request of the plaintiff
  5. Request of the defendant
  6. disputed factual submissions of the defendant
  7. Trial history, for example taking evidence

It is never wrong to leave out legal statements by the parties in the factual report ( Iura novit curia ).

In the subsidy system, the factual report serves as evidence of the use of an earmarked grant. It can be imposed on the subsidy recipient in the form of an ancillary provision to the grant notification and contains the presentation to the subsidy provider of how the objectives formulated in the project description for the project application were met (target / actual comparison).
