Special test (KWG)

Section 44 (1) of the KWG provides for special audits to be carried out by credit institutions in a number of cases. They are ordered by BaFin and usually carried out by the Deutsche Bundesbank or auditing companies.

Special audits include special credit audits, audits for compliance with MaRisk and Section 25a KWG as well as approval audits regarding the use of bank-internal risk control procedures for calculating the regulatory capital adequacy.

  • Special credit checks: These checks relate to B. on the intrinsic value of credit exposures or compliance with Section 13 KWG.
  • Compliance with MaRisk
  • Correctness of the business organization within the meaning of Section 25a KWG, unless it is a question of compliance with special minimum requirements.
  • Suitability of a market risk model for the purposes of capital adequacy under the Solvency Regulation
  • Suitability of the advanced measurement approach ( AMA ) for determining the capital adequacy requirements for operational risk according to the Solvency Regulation
  • Suitability of rating systems as part of an internal ratings based approach ( minimum capital requirements for internal credit risk # on assessments based approach (IRB) IRB ) for credit risks are used, under the Solvency.
