Social Affairs (Labor Law)

Under social affairs understands Works Constitution Act in the first place, the working conditions of the workers .

The works council has a right of co-determination in social matters, insofar as a statutory or collective agreement does not exist , § 87 BetrVG. Social matters that are not subject to the right of co-determination can, if necessary, be regulated by a voluntary works agreement ( Section 88 BetrVG) between the employer and the works council. Occupational safety and corporate environmental protection ( Section 89 BetrVG) are also to be viewed as social matters.
