Spurius (right)
In Roman law , spurius is the name for a child who does not come from an iustum matrimonium , i.e. was born out of wedlock .
The spurius and his mother were cognatically related according to classical law ; between them there was maintenance and inheritance rights . The spurius was neither cognatically nor agnatically related to his father and had no maintenance claim. His status libertatis and civitatis , i.e. his freedom and civil status , followed that of his mother. Since the spurius was legally independent ( sui iuris ) from birth , it was not subject to the Patria Potestas .
It is not known whether the spurius was discriminated against in society.
